 hereby warrants its parts upon the following conditions against defects in materials and workmanship for a period of one year after delivery to Purchaser when used and installed under normal conditions. THE FOREGOING WARRANTY IS IN LIEU OF AND EXCLUDES ALL OTHER WARRANTIES NOT EXPRESSLY SET FORTH HEREIN, WHETHER EXPRESSED OR IMPLIED BY OPERATION OF LAW OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Failure to follow storage and installation instructions will void this limited warranty.
Buyer and installer must inspect each piece before installation. Installer and Buyer waive all defects which could have been discovered by reasonable inspection prior to installation. This includes all misalignment, misfitted parts, dimensional discrepancies and the like.
In the event that any claim is made under this warranty, an authorized representative of shall have the right to inspect the parts and if, in his sole description, said representative determines that parts supplied by are defective, will repair, or as the case may be, replace said defective parts if returned freight is prepaid to 's place of business. In the event that determines that defective parts returned to it cannot be repaired or replaced, then shall refund the amount paid to for the defective parts. The sole obligation and liability of under this warranty is to REPAIR OR REPLACE DEFECTIVE PARTS, f.o.b. 's place of business or make a REFUND as described above.
SHALL HAVE NO LIABILITY TO ANY PERSON, FIRM OR CORPORATION WHATSOEVER FOR INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES such as but not limited to, labor, finishing costs, parts damaged by freight carriers, freight charges, installation, or like.
